June 15, 2017

The Chisago County Board of Commissioners met in regular session at 6:30 p.m. on Wednesday, May 17, 2017 at the Chisago County Government Center with the following Commissioners present:  Greene, McMahon, Montzka, Robinson.  Commissioner Walker was absent.  Also present:  County Attorney Janet Reiter, County Administrator Bruce Messelt, and Clerk of the Board Chase Burnham.  ABSENT: Walker.
 
The Chair called the meeting to order and led the assembly in the Pledge of Allegiance.

Commissioner McMahon offered a motion to approve the amended agenda.  Motion seconded by Greene and upon a vote being taken thereon, the motion carried as follows:  IN FAVOR THEREOF:  Greene, McMahon, Montzka, Robinson OPPOSED: None ABSENT: Walker.

On motion by Greene, seconded by Robinson, the Board moved to recess to the Road and Bridge Committee of the Whole.  The motion carried as follows: IN FAVOR THEREOF:  Greene, McMahon, Montzka, Robinson OPPOSED: None ABSENT: Walker.

The Chair opened the Road and Bridge Committee of the Whole at 6:31.

The Board was given updates on the following current projects of the Public Works Department from County Engineer Joe Triplett;  Project Updates, Projects Currently being engineered/bid/awarded, MN DOT Agreements, Bridge Inspection Agreements.  No action was taken.

On motion by McMahon, seconded by Greene, the Board moved items 1 – 8 to the Consent Agenda. The motion carried as follows:   IN FAVOR THEREOF:  Greene, McMahon, Montzka, Robinson OPPOSED: None ABSENT: Walker.

At 6:36 p.m., the Chair closed the Road and Bridge Committee of the Whole.

RESOLUTION NO. 17/0517-1
MNDOT MASTER PARTNERSHIP CONTRACT RESOLUTION

WHEREAS, The Minnesota Department of Transportation wishes to cooperate closely with local units of government to coordinate the delivery of transportation services and maximize the efficient delivery of such services at all levels of government; and

WHEREAS, MnDOT and local governments are authorized by Minnesota Statutes sections 471.59, 174.02, and 161.20, to undertake collaborative efforts for the design, construction, maintenance and operation of state and local roads; and

WHEREAS, the parties wish to able to respond quickly and efficiently to such opportunities for collaboration, and have determined that having the ability to write “work orders” against a master contract would provide the greatest speed and flexibility in responding to identified needs.

NOW, THEREFORE, BE IT RESOLVED,

1. That the County of Chisago  enter into a Master Partnership Contract with the Minnesota Department of Transportation, a copy of which was before the Board.

2. That the proper County officers are authorized to execute such contract, and any amendments thereto.

3. That the County Engineer is authorized to negotiate work order contracts pursuant to the Master Contract, which work order contracts may provide for payment to or from MnDOT, and that the County Engineer may execute such work order contracts on behalf of the County of Chisago without further approval by this Board.

CLASSIFICATION AND APPRAISAL OF TAX FORFEITED PROPERTY

WHEREAS, The tax parcels on the attached list have forfeited, to the State of Minnesota in trust for the respective taxing districts for nonpayment of real estate taxes;

WHEREAS, In order to be able to sell these parcels at tax sale the County Board of Commissioners need to classify and appraise the tax forfeited parcels pursuant to M.S. 282.01 Subdivision 1.

NOW, THEREFORE, BE IT RESOLVED

1. That the Chisago County Board of Commissioners approve the attached list of classification and appraisal of tax forfeited ready for sale and authorize the Chisago County Auditor-Treasurer to take the necessary steps to offer the parcels for sale pursuant to M.S. 282.01.

2. That the Chisago County Auditor-Treasurer is directed to forward the parcels noted on the attached Classification and Appraisal to the Minnesota DNR pursuant to M.S. 282.01, subd. 3.

3. That the Chisago County Auditor-Treasurer is directed to forward the parcels noted on the attached Classification and Appraisal to the appropriate city and township officials for approval pursuant to M.S. 282.01, subd. 1(h).

15.) Terms and Date for the Public Sale of Tax Forfeited Land pursuant to M.S. 282.01

SALE OF TAX FORFEITED PROPERTY

BE IT RESOLVED That the parcels of lands forfeited to the State for non-payment of taxes, appearing on the List of Tax Forfeited Land #2017-1 filed with the County Auditor-Treasurer, which have been classified and appraised as provided by M.S. 282.01 shall be offered for sale by the County Auditor-Treasurer, said sale to commence at 10:00 A.M. on Wednesday, the 28th day of June 2017, in Room 150B of the Chisago County Government Center and the County Auditor-Treasurer is hereby directed to publish a notice of sale as provided by law.

BE IT FURTHER RESOLVED That the terms of the sale shall be as follows:

1. Full payment shall be made the day of the sale except for those parcels selling for over $40,000 which can be purchased for 30% down with the balance due within 90 days of the sale plus interest of 5% on the unpaid balance.

2. No bid can be accepted for less than the appraised value.

3. All property will be sold as is with no guarantee as to title or marketability.

4. Any property subject to special assessments may have all or part of the     assessment reinstated after the sale, by the municipality.

5. The following costs will be payable beyond the sale price, in addition to the 30% down, the date of the sale.

BE IT RESOLVED, that the Chisago County Board of Commissioners act as the legal sponsor for an application for funding to the State of Minnesota Department of Natural Resources for maintenance and grooming of snowmobile trails managed by the North Branch Sno-Drifters.

BE IT FURTHER RESOLVED, that upon approval of its application by the state, the Chisago County Board of Commissioners may enter into an agreement with the State of Minnesota for the above referenced project and that it will comply with all applicable laws and regulations as stated in the agreement.

BE IT FURTHER RESOLVED, that the County Auditor is hereby authorized to serve as the fiscal agent for the above referenced project.

BE IT FURTHER RESOLVED, that upon approval of its application by the state, the Chisago County Board of Commissioners may enter into an agreement with the State of Minnesota for the above referenced project and that it will comply with all applicable laws and regulations as stated in the agreement.

AUTHORIZING SPONSORSHIP OF SNOWMOBILE TRAILS
OPERATED BY THE WILD RIVER SNOWMOBILE CLUB

BE IT RESOLVED, that the Chisago County Board of Commissioners act as the legal sponsor for an application for funding to the State of Minnesota Department of Natural Resources for maintenance and grooming of snowmobile trails managed by the Wild River Snowmobile Club.

BE IT FURTHER RESOLVED, that upon approval of its application by the state, the Chisago County Board of Commissioners may enter into an agreement with the State of Minnesota for the above referenced project and that it will comply with all applicable laws and regulations as stated in the agreement.

BE IT FURTHER RESOLVED, that the County Auditor is hereby authorized to serve as the fiscal agent for the above referenced project.

Environmental Service Director Kurt Schneider updated the Board on the activities of the Environmental Services Department;  Action Items, Board of Adjustment Update, Planning Commission Update, Permit/Construction Activity, AIS Program Update, Solid Waste Activity Update.  No action was taken.

On motion by Robinson, seconded by Greene, the Board moved to approve the June 21, 2017, scheduling of a public hearing in consideration of public comment on the repeal of the existing 1998/2003 Parks Ordinance(s) and adoption of newly drafted Chisago County Parks Ordinance.  The motion carried as follows: The motion carried as follows:   IN FAVOR THEREOF:  Greene, McMahon, Montzka, Robinson OPPOSED: None ABSENT: Walker.

On motion by Robinson, seconded by McMahon, the Board moved to approve the Roger and Julie Grell Final “Acacia Shores” Final Plat at 50125 Acacia Way, Section 20 and 21, T. 37, R. 22, Nessel Township.  The motion carried as follows: The motion carried as follows:   IN FAVOR THEREOF:  Greene, McMahon, Montzka, Robinson OPPOSED: None ABSENT: Walker.

On motion by Robinson, seconded by McMahon, the Board moved to approve the Isaiah Maring Conditional Use Permit at 2210 460th Street, Harris (Fish Lake Township, PID #03.00128.00) to allow a gathering venue as a rural retail tourism use, with Findings and Conditions as recommended by the Planning Commission and/or as amended at tonight’s meeting.  The motion carried as follows: The motion carried as follows:   IN FAVOR THEREOF:  Greene, McMahon, Montzka, Robinson OPPOSED: None ABSENT: Walker.

CONDITIONS:

1.  This is a Conditional Use Permit allowing the use of the subject property as a gathering venue, in accordance with the following conditions of approval.

2. There shall be a maximum of two large-scale events per month and one small scale event per week.  

• “Large-scale event” shall be defined as a single-day event which hosts between 50 and 250 guests and 15 staff.

• Small-scale event shall be defined as non-family single-day event which hosts up to 50 guests.

3. Permitee shall establish and maintain a row of non-deciduous (evergreen) trees at least five feet in height, along 460th Street behind the line of maple trees that has been planted by the applicant.  The evergreens shall commence at the westerly edge of the woods at the southeast corner of the property (i.e. approximately 150 feet west of the centerline of Co. Rd. 8) and extend westerly to the first driveway, and terminate there.  The row of evergreens shall recommence on the west side of the second driveway and extend further west a distance of approximately 200 feet, to a point just past the driveway of the house at 2141 460th St.  

4.  All outdoor events shall conclude by 10:00 p.m. and outdoor sound-producing activities shall terminate by 8:00 p.m.  Amplified outdoor music shall be prohibited, except in the case of a wedding, in which case it shall be limited to the duration of the ceremony.

5.  All indoor events shall conclude by midnight, indoor music shall conclude by 10:00 p.m.

6.  All vehicle parking and management shall be fully accommodated on-site, with no parking or stacking on public County or Township Roads

7.  Any food preparation, service or other provisioning carried out at the site shall comply with all applicable Minnesota Department of Health regulations.

8.  Any liquor service shall be in accordance with all applicable MN Department of Public Safety regulations, and Chisago County liquor licensing requirements.  

9.  Any excessive impact to the Township Road from traffic generated by this business shall be mitigated through a negotiated agreement between the business operator and the Fish Lake Township Board, as determined to be necessary by the Township as the business grows and fully develops.

10.  Dust control shall be required on an as-needed basis, to be determined by the Department of Environmental Services; such dust control shall be provided at the expense of the business operator.

11.  All necessary building and/or septic permits shall be obtained, required inspections shall be made, and repairs or retro-fitting of existing buildings shall be carried out to accommodate the new occupancy (pursuant to review and certification by a qualified architect/engineer).  All required work shall be completed and approved prior to occupancy or use of the structures.

12. All on-site activities shall be operated in accordance with the business operating plan submitted and on file with the Department, except where the plan conflicts with or is otherwise inconsistent with the conditions of this CUP.  

13.  The permit holder shall notify the County annually that the activity permitted by the CUP is ongoing, and the activities being conducted continue to adhere to the conditions of approval.

On motion by Robinson, seconded by Greene, the Board moved to approve the Interim Use Permit as requested by Jason and Jennifer Thompson to operate a rubbish pick-up service as a home-based contracting business as recommended by the Planning Commission and/or as amended at tonight’s meeting.  The motion carried as follows: The motion carried as follows:   IN FAVOR THEREOF:  Greene, McMahon, Montzka, Robinson OPPOSED: None ABSENT: Walker.

CONDITIONS:

1.  This is an interim use permit to conduct a family-owned rubbish hauling business from the premises, as a home-based contracting business, in accordance with the below-stipulated conditions.

2.  A maximum of five commercial trucks shall be parked and/or stored on-site at any one time.

3.  The business shall employ a maximum of four employees or four full-time equivalents.

4.  There shall be no retail or customer traffic to and from the site.

5.  All storage of recycling/problem materials/bulky recyclables shall be inside the pole barn, and shall be temporary, pending transfer for final disposal off-site.

6.  There shall be no on-site signage associated with this business.  

7.  There shall be no storage of municipal solid waste except personal trash generated by the property owner.

8.  The days and hours of operation for the business shall be Monday through Saturday, from 7:00 a.m. to 8:00 p.m.

9.  There shall be no processing of solid waste on-site.

10.  Permittee shall obtain and maintain the required solid waste license from Chisago County.

11.  Permittee shall construct an additional building at such time as it is determined to be necessary to keep all vehicles, equipment and materials under cover and out of sight.

12.  The permit holder must notify the County annually that the activity permitted by the IUP is ongoing, and the activities being conducted continue to adhere to the conditions of approval.  

On motion by Greene, seconded by McMahon, the Board moved to approve the voluntary surrender of the Melissa Carpentier Anderson and Ryan Anderson sled dog kennel Interim Use Permit at 13645 River Road, Sunrise Township, Sec. 3, T.35, R.20, at 13645 River Road (PID #09.0009.10.).  The motion carried as follows: The motion carried as follows:   IN FAVOR THEREOF:  Greene, McMahon, Montzka, Robinson OPPOSED: None ABSENT: Walker.

On motion by Robinson, seconded by McMahon, the Board moved to approve the voluntary surrender of the Kendall and Tracy Lundahl art studio rural retail tourism use Conditional Use Permit located in Nessel Township, Sec.8, T.37, R.22, PID #06.00196.30 (no address).  The motion carried as follows: The motion carried as follows:   IN FAVOR THEREOF:  Greene, McMahon, Montzka, Robinson OPPOSED: None ABSENT: Walker.

On motion by McMahon, seconded by Robinson, the Board moved to approve and authorize the County Board Chair and County Attorney to effect, undertake and execute on behalf of the County and the County Board, the following actions regarding completion of the Swedish Immigrant Regional Trail Segment F Connection Project:

• Completion and Execution of a Grant Agreement with the Greater Minnesota Regional Parks and Trails Commission for construction of Segment F-2 of the SIRT

• Completion and Execution of a Contract Amendment with KLJ to serve as the County’s Right of Way (ROW) Agent to complete needed survey work, title research, appraisals and negotiations for acquisition of property/easement, as previously initiated and required to complete Segment F-2 of the SIRT
 
• Completion and Execution of property/easement acquisitions required and necessary for construction of Segment F-2 of the SIRT, pursuant to the ROW Agent’s completion of needed appraisals and negotiations or, should all other efforts fail, as is required under Minnesota Statutes, via initiation of a government taking of remaining parcels, as delineated in the attached Resolution.

AUTHORIZING THE ACQUISITIONS OF LAND BY CONDEMNATION
FOR THE CONSTRUCTION OF THE SWEDISH IMMIGRANT REGIONAL TRAIL “SEGMENT F” PROJECT

WHEREAS, Chisago County proposes to construct a public multi-use recreational trail in Chisago County known as the Swedish Immigrant Regional Trail; and

WHEREAS, fee interests over certain lands are required to provide for said trail construction of “Segment F”, attached in Exhibit A and as identified in the Swedish Immigrant Regional Trail Master Plan; and

WHEREAS, Chisago County is acquiring property for a public purpose, namely, the possession, ownership, occupation and enjoyment of the Swedish Immigrant Regional Trail by the general public; and

WHEREAS, the following person(s) own or have an interest in a portion of said lands required for fee interest as identified in attached Exhibit A; and

WHEREAS, Chisago County has been unable to successfully negotiate the acquisition of the required fee interests; and

WHEREAS, Chisago County has the right to acquire the right-of-way prior to the filing of an award by the court appointed commissioners, pursuant to Minn. Stat. § 117.011 and § 117.042.

NOW THEREFORE BE IT RESOLVED, that the Chisago County Board of Commissioners hereby authorizes the acquisition of said land by eminent domain and to take title and possession of such lands prior to the filing of an award by the court appointed commissioner, pursuant to Minn. Stat. §163.02, subd. 2; §117.011; and §117.042; and

BE IT FURTHER RESOLVED, that the Chisago County Attorney is requested to file the necessary Petitions therefore, and to prosecute such actions to a successful conclusion or until it is abandoned, dismissed, or terminated by the County or the Court.

At 7:02 p.m., the Chair opened Citizen Forum.  1 Citizen spoke; the Chair closed Citizen Forum at 7:06 p.m.

County Veterans Service Officer Al Budde provided the Board with an update regarding the Veterans Service Office’s activities.  No action taken.

APPOINTING BRYAN BROWN TO A FOUR YEAR TERM AS
CHISAGO COUNTY VETERAN’S SERVICE OFFICER

WHEREAS, Minnesota Statute 197.60 provides for each County Board of the State of Minnesota to fill the office of County Veteran’s Service Officer by appointment for a term of four years; and

WHEREAS, Minnesota Statute 197.60, Subd. 2 provides that the first 12 months of the initial appointment be a probationary period; and

WHEREAS, the veterans and their families of Chisago County will be well served by the oversight of the appointment of Veteran Bryan Brown;

NOW, THEREFORE, BE IT RESOLVED that the Chisago County Board of Commissioners hereby appoints Bryan Brown for a four year term, effective May 31, 2017.

On motion by McMahon, seconded by Robinson, the Board moved to approve the Service Level Agreement Administration of Revenue Recapture.  The motion carried as follows: The motion carried as follows:   IN FAVOR THEREOF:  Greene, McMahon, Montzka, Robinson OPPOSED: None ABSENT: Walker.

On motion by Greene, seconded by McMahon, the Board moved to approve the New Member Sign up MNTAXLINK Work Order with MCCC for the County Assessor’s Office.  The motion carried as follows: The motion carried as follows:   IN FAVOR THEREOF:  Greene, McMahon, Montzka, Robinson OPPOSED: None ABSENT: Walker.

On motion by McMahon, seconded by Greene, the Board moved to approve the recommendations of the Budget and Finance Committee from May 15th 2017 Meeting as delineated in tonight’s Committee Report.  The motion carried as follows: The motion carried as follows:   IN FAVOR THEREOF:  Greene, McMahon, Montzka, Robinson OPPOSED: None ABSENT: Walker.

County Administrator Messelt provided the following updates: May 15th National Police Officers Day, Intern Introductions, Nessel Tower Update.  No action was taken.

Several Commissioners offered reports of their respective committee assignments. No action was taken.

Chair Montzka announced that the Board will be closing the meeting to hold a Closed Meeting of the Board of Commissioners to discuss Minnesota Monitoring vs. Chisago County Board of Commissioners, and related claims as expressed authorized by MN Stat. 13D.05, permitted by the attorney-client privilege.  On motion by Greene, seconded by McMahon and carried unanimously the Board closed the meeting and convened a closed session at 7:41 p.m.  The motion carried as follows:  IN FAVOR THEREOF: Greene, McMahon, Montzka, Robinson OPPOSED: None ABSENT: Walker.

Following the closed session, the Chisago County Board of Commissioners reconvened the Meeting of the Whole. Pursuant to M.S. 13D.05, the following were present at the closed meeting: Chairperson Montzka, Commissioner Greene, Commissioner McMahon, Commissioner Robinson, Assistant County Attorney Fuge, County Administrator Messelt, and Clerk to the Board Chase Burnham.    

Chair Montzka reconvened the meeting at 7:49 p.m.

On motion by Greene, seconded by McMahon, the Board adjourned the meeting at 7:49 p.m.  The motion carried as follows:  IN FAVOR THEREOF:  Greene, McMahon, Montzka, Robinson OPPOSED: None ABSENT: Walker.
