Marine on St. Croix man facing criminal vehicular homicide charge
A Washington County resident is facing four counts of felony, gross misdemeanor and misdemeanor charges after being arrested in connection with a fatality on I-35 early Friday morning, November 1. The crash closed the freeway and sent law enforcement on a search when only one vehicle was found at the crash site and it was apparent there had to have been two drivers involved.
Charged with DUI within 10 years of a prior offense, a felony, is Samuel Dakota Moreno, 23, Marine on St Croix. He is also charged with gross misdemeanor DUI, a felony leaving the scene--and driving after revocation which is a misdemeanor. The prior offense was an OWI in Wisconsin in 2016, according to the complaint.
A state patrol trooper was met at the crash scene by North Branch Police, North Branch fire and county deputies. They responded when someone reported a vehicle on its roof in the ditch of the northbound freeway lane, near Hwy 95 about 5:30 a.m. last Friday.
Despite extrication and EMS efforts the driver of the flipped car, 63 year-old Joffre Michael Kolosky, of Moose Lake, died at the scene. He had been driving a Buick Park Avenue that looked to have been hit in the rear.
There was reportedly a trail of liquid that authorities noticed in the northbound lane and a county deputy tracked it and quickly spotted a truck with front end damage at Goose Creek Rest Area, a little north of the crash site.
According to the complaint the deputy found Moreno, believed to be the operator of the second vehicle, lying on the rest room floor. Using his Taser and assisted by a state patrol trooper who arrived at the rest area, the deputy was able to subdue and detain the suspect.
A blood sample from Moreno was being tested early this week.
The front license plate found at the fatal crash site matched the plate missing from the truck, located at the rest area.
Moreno appears in court again November 26.
