CHISAGO COUNTY BOARD OF COMMISSIONERS OFFICIAL PROCEEDINGS - Wednesday, February 7, 2018

(March 1, 2018)

The Chisago County Board of Commissioners met in regular session at 6:30 p.m. on Wednesday, February 07, 2018 at the Chisago County Government Center with the following Commissioners present:  Greene, McMahon, Montzka, Robinson.  Commissioner Walker appeared via Electronic Means pursuant to MN Stat. 13D.015.     Also present:  County Attorney Janet Reiter, County Administrator Bruce Messelt, and Interim Clerk of the Board Danielle Lord.
 
The Chair called the meeting to order and led the assembly in the Pledge of Allegiance.

Commissioner Montzka offered a motion to approve the agenda.  Motion seconded by Greene and upon a vote being taken thereon, the motion carried as follows:  IN FAVOR THEREOF:  Greene, McMahon, Montzka, Robinson, Walker OPPOSED: None.

The Chair opened the Health and Human Services Committee of the Whole at 6:30 p.m.

Nancy Dahlin provided the Board with the following Chisago County Community Health Board Updates: Mental Health service interests; Clubhouse/ Drop in Center Development; Chemical Health Assessments; Child Protection Intakes.  No action was taken.

On motion by Greene, seconded by Montzka, the Board moved to accept the Director of Health and Human Services Report. The motion carried as follows:   IN FAVOR THEREOF:  Greene, McMahon, Montzka, Robinson, Walker OPPOSED: None.

On motion by McMahon, seconded by Robinson, the Board moved items 2 – 7 to the Consent Agenda. The motion carried as follows:   IN FAVOR THEREOF:  Greene, McMahon, Montzka, Robinson, Walker OPPOSED: None.

On motion by Montzka, seconded by Greene, the Board moved to close the Health & Human Services Committee of the Whole.  The motion carried as follows:   IN FAVOR THEREOF:  Greene, McMahon, Montzka, Robinson, Walker OPPOSED: None.

At 6:55 p.m. the Chair closed the Health & Human Services Committee of the Whole.
At 6:57 p.m., the Chair opened Citizen Forum.  0 Citizen spoke; the Chair closed Citizen Forum at 6:57 p.m.

On motion by Walker, seconded by Greene, the Board moved to approve the Consent Agenda.  The motion carried as follows:   IN FAVOR THEREOF:  Greene, McMahon, Montzka, Robinson, Walker OPPOSED: None.

Chisago County Auditor/ Treasurer Dennis Freed and Chief Deputy Auditor/ Treasurer Bridgitte Konrad Director updated the Board on the activities of the Auditor/ Treasurer Department; Conveyance of the Tax Forfeited Property to Chisago Lakes Township, and Repurchasing of Tax Forfeited parcels pursuant to 282.241.  No action was taken.

On motion by Greene, seconded by Robinson, the Board moved to approve  the Authorization for County Auditor to Transfer Funds The motion carried as follows:  IN FAVOR THEREOF:  Greene, McMahon, Montzka, Robinson, Walker OPPOSED: None.

On motion by Walker, seconded by Greene, the Board moved to approve the Conveyance of Tax Forfeited Property to Chisago Lakes Township. The motion carried as follows: IN FAVOR THEREOF: Greene, McMahon, Montzka, Robinson, Walker OPPOSED: None.

RESOLUTION NO. 18/0207-01
TAX FORFEITED LAND TO CHISAGO LAKES TOWNSHIP

WHEREAS, the Township of Chisago Lakes has submitted a request for tax forfeited parcel 02.01271.17 to be conveyed to the Township for an authorized public purpose under M.S. 282.01, subdivision 1a, paragraph (f),

WHEREAS, M.S. 282.01, subdivision 1a, paragraph (f) authorizes  conveyance, with County Board approval, of tax forfeited land to a local government subdivision if they certify to the Board that prior to forfeiture the government subdivision was entitled to the parcel under a written development agreement.

NOW THEREFORE BE IT RESOLVED, that the Chisago County Board of Commissioners approve the conveyance of tax forfeited parcel 02.01271.17 for an authorized public use to the Township of Chisago Lakes pursuant to M.S. 282.01, subdivision 1a, paragraph (f).

On motion by Greene, seconded by Robinson, the Board moved to approve the Repurchase of Tax Forfeited Parcels pursuant to 282.241. The motion carried as follows: IN FAVOR THEREOF: Greene, McMahon, Montzka, Robinson, Walker OPPOSED: None.

RESOLUTION NO. 18/0207-02
REPURCHASING OF TAX FORFEITED PROPERTY BY JP MORGAN CHASE

WHEREAS, JP Morgan Chase Bank NA, the mortgage holder, has made and filed an application with the County Auditor-Treasurer for the repurchase of the hereinafter described parcel of tax forfeited land, in accordance with the provisions of Minnesota Statutes, Section 282.241, as amended, which land is situated in the County of Chisago, Minnesota, and described as follows, to-wit:

Parcel # 06.00160.00

Part of the West 300 feet of the East 660 feet of the Southeast ¼ of the Southeast ¼, Section 4, Township 37, Range 22, Chisago County, Minnesota, lying North of the South 924 feet thereof.

WHEREAS, said applicant has set forth in his application that:  taxes were unpaid because the lender was unaware that the contiguous parcels contained two separate parcel identification numbers,

WHEREAS, this Board is of the opinion that undue hardship resulted from the forfeiture and the repurchase will be in the best interest of the public and said applications should be granted for such reasons,

NOW THEREFORE BE IT RESOLVED, that the application of JP Morgan Chase Bank, NA, for the repurchase of the above described parcel of tax forfeited land be and the same is hereby granted and the County Auditor-Treasurer is hereby authorized and directed to permit such repurchase according to the provisions of Minnesota Statutes, Section 282.241, as amended.

On motion by Robinson, seconded by Greene, the Board moved to approve the Purchase of Voting Equipment. The motion carried as follows: IN FAVOR THEREOF: Greene, McMahon, Montzka, Robinson, Walker OPPOSED: None.

RESOLUTION NO. 18/0207-03
ELECTION EQUIPMENT PURCHASE

WHEREAS, Chisago County was awarded a Voting Equipment Grant from the Minnesota Secretary of State in the amount of $42,734.   Minnesota counties are responsible for administering elections, which includes the purchase and maintenance of supplies and election equipment, including accessible voting equipment; and

WHEREAS, there are budgeted funds of $330,760 in the 2018 capital improvement budget for election equipment and $49,755 of election equipment carryover to fund the purchase; and

WHEREAS, Minnesota solicited bids for election equipment in November 2017 and approved State Contract pricing for this equipment; and

WHEREAS, it’s essential for our County to have voting equipment that allows our voters to cast their ballot on equipment that is secure, accessible, accurate, and reliable; and

NOW, THEREFORE, BE IT RESOLVED
That the County Board of Commissioners of Chisago County approves purchase of the following election equipment utilizing Grant and County budgeted funds for the purchase:

• Hart Intercivic – Precinct counters and assistive voting devices $307,011.14
• Knowink – Electronic pollbooks $114,650.00

BE IT FURTHER RESOLVED, the County Auditor-Treasurer is authorized to sign all purchase agreements and documentation necessary to complete the purchase.

On motion by Robinson, seconded by Greene, the Board moved to approve Out of State Travel Request for Sgt. Scott Berg, Camp Dodge, Iowa- Lab Safety Recert..  The motion carried as follows:  IN FAVOR THEREOF:  Greene, McMahon, Montzka, Robinson, Walker OPPOSED: None.

On motion by Walker, seconded by Greene, the Board moved to accept the 2017 Urban Area Security Initiative Grant. The motion carried as follows:  IN FAVOR THEREOF:  Greene, McMahon, Montzka, Robinson, Walker OPPOSED: None.

On motion by Montzka, seconded by Greene, the Board moved to accept the Service for Cable TV and Telephone Lines for the new Jail/LEC.The motion carried as follows:  IN FAVOR THEREOF:  Greene, McMahon, Montzka, Robinson, Walker OPPOSED: None.

On motion by Montzka, seconded by Greene, the Board moved to approve the Final Cleaning of Justice Center for new Jail/LEC. The motion carried as follows:  IN FAVOR THEREOF:  Greene, McMahon, Montzka, Robinson, Walker OPPOSED: None.

On motion by Montzka, seconded by Greene, the Board moved to approve the Epoxy Sealant for new Jail 1st Floor Dayrooms and ADA Cell Showers. The motion carried as follows:  IN FAVOR THEREOF:  Greene, McMahon, Montzka, Robinson, Walker OPPOSED: None.

On motion by Greene, seconded by Montzka, the Board moved to approve the Advertisement for Bids for Swedish Immigrant Trail- Seg. F Connection Project.  The motion carried as follows:  IN FAVOR THEREOF:  Greene, McMahon, Montzka, Robinson, Walker OPPOSED: None.

On motion by Montzka, seconded by Walker, the Board moved to approve the Final Contract Payment for CP 13-SPT-17 Sunrise Prairie Trail Construction. The motion carried as follows:  IN FAVOR THEREOF:  Greene, McMahon, Montzka, Robinson, Walker OPPOSED: None.

On motion by Greene, seconded by Montzka, the Board moved to approve the Computer Assisted Mass Appraisal Software Purchase and Software Maint. Agreement. The motion carried as follows:  IN FAVOR THEREOF:  Greene, McMahon, Montzka, Robinson, Walker OPPOSED: None

On motion by Robinson, seconded by Greene, the Board moved to approve the Letter of Recognition of Closure of Fairview Clinic Rush City. The motion carried as follows:  IN FAVOR THEREOF:  Greene, McMahon, Montzka, Robinson, Walker OPPOSED: None

On motion by Robinson, seconded by Greene, the Board moved to approve the Application for Exempt Gambling Permit- Minnesota Deer Hunter’s Association. The motion carried as follows:  IN FAVOR THEREOF:  Greene, McMahon, Montzka, Robinson, Walker OPPOSED: None

RESOLUTION NO. 18/0207-04
APPROVING SUBMISSION OF AN EXEMPT PERMIT FOR GAMBLING FOR THE WILD RIVER CHAPTER MINNESOTA DEER HUNTERS
ASSOCIATION

WHEREAS, the Chisago County Board of Commissioners has been presented with a request for lawful gambling within Chisago County; and

WHEREAS, the application was complete, included all necessary documentation, appears in accordance with County Policies and the facility owners are in good standing with the County;

BE IT RESOLVED that the Chisago County Board of Commissioners hereby approves and authorizes submission to the Minnesota Gambling Control Board an application from Wild River Chapter Minnesota Deer Hunters Association for Bingo and a raffle at the Lent Town Hall is located at 33155 Hemingway Ave., Stacy, MN 55079 on March 10th, 2018.   

County Administrator Messelt provided the following updates: Correspondence.  No action was taken.

Several Commissioners offered reports of their respective committee assignments. No action was taken.

On motion by Walker, seconded by Montzka, the Board adjourned the meeting at 7:56 p.m.  The motion carried as follows:  IN FAVOR THEREOF:  Greene, McMahon, Montzka, Robinson, Walker OPPOSED: None.
