CENTER CITY PLANNING COMMISSION - VARIANCES TO ALLOW A DECK TO ENCROACH ON THE FIFTY FOOT LAKE SETBACK OF BOTH NORTH CENTER LAKE AND PIONEER LAKE AND A VARIANCE TO EXCEED THE TWENTY-FIVE PERCENT LOT COVERAGE REQUIREMENT FOR A SINGLE FAMILY DETACHED STRUCTURE IN THE SHORELAND DISTRICT

(March 8, 2017)

NOTICE IS HEREBY GIVEN that the Center City Planning Commission will conduct a public hearing on Monday, March 19, 2018 at 7:00 p.m., or as soon thereafter as possible, for a variance request of fifty feet (50') or more to reduce the lakeshore setback from North Center Lake from fifty feet (50') to zero feet (0') to allow for the encroachment of a deck; a variance of twenty-one and two tenths feet (21.2') to reduce the lakeshore setback from Pioneer Lake from fifty feet (50') to twenty-eight and eight tenths feet (28.8') to allow for the encroachment of a deck; and a variance to exceed the twenty-five percent (25%) lot coverage requirement by two hundred and eighteen (218) square feet. The property is located at 425 North Main Street, Center City, MN. The meeting will be held in the Council Chambers at City Hall, at 300 North Center Avenue where all persons may reasonably be heard.

The property is legally described as follows:

That part of Government Lot 3, Section 27, Township 34 North, Range 20 West, Chisago County, Minnesota, described as follows:

Commencing at the most southerly corner of Lot 8, Block 7 of the recorded plat of CENTRE CITY, Chisago County, Minnesota, thence North 17 degrees 09 minutes 19 seconds East, assumed bearing along the westerly line of said Lot 8, a distance of 199.77 feet, to the most northerly corner of said Lot 8, thence North 43 degrees 38 minutes 39 seconds West, a distance of 29.88 feet; thence North 16 degrees East, a distance of 220.00 feet, thence North 11 degrees 31 minutes East, a distance of 350.42 feet to a point hereinafter known as "Point A"; thence North 75 degrees 40 minutes West, a distance of 35.00 feet, thence North 35 degrees 56 minutes 30 seconds West, a distance of 98.86 feet, thence North 32 degrees 06 minutes 52 seconds West, a distance of 80.08 feet to the point of beginning of the parcel to be described; thence North 61 degrees 56 minutes 12 seconds East, a distance of 108 feet, more or less, to the shoreline of Pioneer Lake; thence southerly along said shoreline, a distance of 246 feet, more or less, to its intersection with a line that bears south 75 degrees 40 minutes East, from said "Point A"; thence North 75 degrees 40 minutes West, a distance of 151 feet, more or less, to the shoreline of North Center Lake; thence northwesterly, along said shoreline, a distance of 180 feet, more or less, to its intersection with a line that bears South 61 degrees 56 minutes 12 seconds West, from the point of beginning; thence North 61 degrees 56 minutes 12 seconds East, along said line, a distance of 35 feet, more or less, to the point of beginning.

Together with a 12 foot roadway easement extending form the southerly line of Nelson Court to the Northerly line of the above described parcel. The westerly line of said 12 foot easement is described as follows:

Commencing at the southerly corner of Lot 28 of the recorded plat of CEDAR POINT, thence North 61 degrees 56 minutes 12 seconds East, assumed bearing along the southerly line of Nelson Court, a distance of 23.6 feet to the point of beginning of said westerly line to be described; thence South 24 degrees 11 minutes 48 seconds East, a distance of 80.10 feet; thence South 19 degrees 53 minutes 48 seconds East, a distance of 80.70 feet to the Northerly line of the above described parcel and said westerly line there terminating.

Subject to easements recorded as Documents Nos. 115707, 149747 and 149748.

Subject to and together with any other valid easements, restrictions and reservations.

Any person desiring to comment on this matter is invited to do so in writing (prior to or at the hearing) or orally at the time of the public hearing.
