CHISAGO COUNTY BOARD OF COMMISSIONERS OFFICIAL PROCEEDINGS: Wednesday, May 01, 2019

(May 23, 2019)

The Chisago County Board of Commissioners met in regular session at 6:30 p.m. on Wednesday, May 01, 2019 at the Chisago County Government Center with the following Commissioners present:  DuBose, Greene, McMahon, Montzka, Robinson.  Also present:  County Attorney Janet Reiter, and Clerk of the Board Chase Burnham.
 
The Chair called the meeting to order and led the assembly in the Pledge of Allegiance.

Commissioner McMahon offered a motion to approve the amended agenda.  Motion seconded by Montzka, the motion carried as follows:  IN FAVOR THEREOF:  DuBose, Greene, McMahon, Montzka, Robinson OPPOSED: None.

On motion by Robinson, seconded by McMahon, the Board moved to recess the Board of Commissioners meeting to the Health and Human Services Committee of the Whole.  The motion carried as follows:   IN FAVOR THEREOF:  DuBose, Greene, McMahon, Montzka, Robinson OPPOSED: None.

Chair Greene gave the gavel to Vice-Chair Montzka.

The Chair opened the Health and Human Services Committee of the Whole at 6:31 p.m.

Monica Long provided the Board with the following Chisago County Health and Human Services Updates:  HHS Legislative Update, Overview of Children’s Mental Health Status, CMH Eligibility Criteria and Requests for Board Action.  No action was taken.

On motion by DuBose, seconded by McMahon, the Board moved items 1 – 2 to the Consent Agenda. The motion carried as follows:  IN FAVOR THEREOF:  DuBose, Greene, McMahon, Montzka, Robinson OPPOSED: None.

On motion by Greene, seconded by McMahon, the Board moved to close the Health & Human Services Committee of the Whole.  The motion carried as follows:   IN FAVOR THEREOF:  DuBose, Greene, McMahon, Montzka, Robinson OPPOSED: None.

At 6:46 p.m. the Chair closed the Health & Human Services Committee of the Whole.
    
On motion by Montzka, seconded by McMahon, the Board moved to approve the Consent Agenda.  The motion carried as follows:   IN FAVOR THEREOF:  DuBose, Greene, McMahon, Montzka, Robinson OPPOSED: None.

On motion by Robinson, seconded by Montzka, the Board moved to approve the applications of abatement of taxes for the following tax parcels; 21.10640.20, 20.00303.10, 03.00135.10, 11.01035.42, 13.00454.00, 11.01070.73, 02.00392.28, 02.00392.27, 06.00703.00, 60.00692.00 and 02.01314.00.  The motion carried as follows:  IN FAVOR THEREOF:  DuBose, Greene, McMahon, Montzka, Robinson OPPOSED: None.
    
On motion by DuBose, seconded by McMahon, the Board moved to approve Pheasants Forever’s resolution to apply for a raffle at the Lent Town Hall on February 29th, 2020.  The motion carried as follows:  IN FAVOR THEREOF:  DuBose, Greene, McMahon, Montzka, Robinson OPPOSED: None.

RESOLUTION NO. 19/0501-1
APPROVING SUBMISSION OF AN EXEMPT PERMIT FOR GAMBLING FOR THE PHEASANTS FOREVER

WHEREAS, the Chisago County Board of Commissioners has been presented with a request for lawful gambling within Chisago County; and

WHEREAS, the application was complete, included all necessary documentation, appears in accordance with County Policies and the facility owners are in good standing with the County;

BE IT RESOLVED that the Chisago County Board of Commissioners hereby approves and authorizes submission to the Minnesota Gambling Control Board an application from the Pheasants Forever for a raffle at Lent Town Hall is located at 33155 Hemingway Ave., Stacy, MN 55079 on February 29th, 2020.   

On motion by DuBose, seconded by McMahon, the Board moved to approve the attached resolutions approving the sale of tax forfeited land.  The motion carried as follows:  IN FAVOR THEREOF:  DuBose, Greene, McMahon, Montzka, Robinson OPPOSED: None.

RESOLUTION NO. 19/0501-2
APPROVING TAX FORFEIT SALE

BE IT RESOLVED That the parcels of lands forfeited to the State for non-payment of taxes, appearing on the List of Tax Forfeited Land #2019-1 filed with the County Auditor-Treasurer, which have been classified and appraised as provided by M.S. 282.01 shall be offered for sale by the County Auditor-Treasurer, said sale to commence at 10:30 A.M. on Thursday, the 20th day of June 2019, in Room 150B of the Chisago County Government Center and the County Auditor-Treasurer is hereby directed to publish a notice of sale as provided by law.

BE IT FURTHER RESOLVED That the terms of the sale shall be as follows:

1. Full payment shall be made the day of the sale except for those parcels selling for over $40,000 which can be purchased for 30% down with the balance due within 90 days of the sale plus interest of 5% on the unpaid balance.

2. No bid can be accepted for less than the appraised value.

3. All property will be sold as is with no guarantee as to title or marketability.

4. Any property subject to special assessments may have all or part of the assessment reinstated after the sale, by the municipality.

5. The following costs will be payable beyond the sale price, in addition to the 30% down, the date of the sale.

A.  State Deed Fee 25.00
B.  Recording Fee 46.00
C.  State Deed Tax .33% of the sale price
D.  Assurance Fee 3% of the sale price

RESOLUTION NO. 19/0501-3
APPROVING ADJOINING LAND SALE

BE IT RESOLVED That the parcel of land forfeited to the State for non-payment of taxes, appearing on the List of Tax Forfeited Land #2019-2 and filed with the County Auditor-Treasurer, which have been classified and appraised as provided by M.S. 282.01 shall be offered for sale by the County Auditor-Treasurer to the adjoining landowners, pursuant to M.S, 282.01 Subdivision 7A, said sale shall be by auction and will commence at 11:30 a.m. on the 20th day of June 2019, in Room 150B of the Chisago County Government Center. The County Auditor-Treasurer is hereby directed to mail written notice of the sale as provided by law.

BE IT FURTHER RESOLVED That the terms of the sale shall be as follows:

1. No bid can be accepted for less than the appraised value.

2. All property will be sold as is with no guarantee as to title or marketability.

3. Any property subject to special assessments may have all or part of the assessment reinstated after the sale, by the municipality.

RESOLUTION NO. 19/0501-4
APPROVING CLASS AND APPRAISAL

WHEREAS, The tax parcels on the attached list have forfeited, to the State of Minnesota in trust for the respective taxing districts for nonpayment of real estate taxes;

WHEREAS,   In order to be able to sell these parcels at tax sale the County Board of Commissioners need to classify and appraise the tax forfeited parcels pursuant to M.S. 282.01 Subdivision 1.

NOW, THEREFORE, BE IT RESOLVED

 That the Chisago County Board of Commissioners approve the attached list of classification and appraisal of tax forfeited ready for sale and authorize the Chisago County Auditor-Treasurer to take the necessary steps to offer the parcels for sale pursuant to M.S. 282.01.

That the Chisago County Auditor-Treasurer is directed to forward the parcels noted on the attached Classification and Appraisal to the Minnesota DNR pursuant to M.S. 282.01, subd. 3.

That the Chisago County Auditor-Treasurer is directed to forward the parcels noted on the attached Classification and Appraisal to the appropriate city and township officials for approval pursuant to M.S. 282.01, subd. 1(h).

On motion by DuBose, seconded by Montzka, the Board moved to approve the attached resolution approving conveyance of tax forfeit propery to the Township of Lent for park purposes.  The motion carried as follows:  IN FAVOR THEREOF:  DuBose, Greene, McMahon, Montzka, Robinson OPPOSED: None.

RESOLUTION NO. 19/0501-5
APPROVING CONVEYANCE TO LENT

WHEREAS, the Township of Lent has submitted a request for tax forfeited parcel 05.00728.21 to be conveyed to the Township for an authorized public purpose under M.S. 282.01, subdivision 1a, paragraph (f),

WHEREAS, M.S. 282.01, subdivision 1a, paragraph (f) authorizes  conveyance, with County Board approval, of tax forfeited land to a local government subdivision if they certify to the Board that prior to forfeiture the government subdivision was entitled to the parcel under a written development agreement.
    
NOW THEREFORE BE IT RESOLVED, that the Chisago County Board of Commissioners approve the conveyance of tax forfeited parcel 05.00728.21 for an authorized public use to the Township of Lent pursuant to M.S. 282.01, subdivision 1a, paragraph (f).

On motion by Montzka, seconded by McMahon, the Board moved to recess the Board of Commissioners meeting and to convene the Regional Rail Authority at 6:50 p.m.  The motion carried as follows:   IN FAVOR THEREOF:  DuBose, Greene, McMahon, Montzka, Robinson OPPOSED: None.    

On motion by Montzka, seconded by McMahon, the Board moved to issue a letter to the Federal Highway Administration so Mndot can acquire permanent easements along the Sunrise Prairie Trail. The motion carried as follows:   IN FAVOR THEREOF:  DuBose, Greene, McMahon, Montzka, Robinson OPPOSED: None.

On motion by McMahon, seconded by Montzka, the Board moved to close the Regional Rail Authority at 6:51 p.m. and to reconvene the Chisago County Board of Commissioners meeting.  The motion carried as follows:   IN FAVOR THEREOF:  DuBose, Greene, McMahon, Montzka, Robinson OPPOSED: None.
    
On motion by Robinson, seconded by DuBose, the Board moved to award the S.A.P. 013-639-004 project and approve the contract with Landwehr Construction Inc. for the CSAH 39 Timber Bridge Replacement project.  The motion carried as follows:  IN FAVOR THEREOF:  DuBose, Greene, McMahon, Montzka, Robinson OPPOSED: None.

On motion by McMahon, seconded by DuBose, the Board moved to approve the Out of state travel for MICS Director Jon Eckel to attend the Honeywell User Group in Phoenix, Arizona June 9-13th, 2019.  The motion carried as follows:  IN FAVOR THEREOF:  DuBose, Greene, McMahon, Montzka, Robinson OPPOSED: None.

On motion by Robinson, seconded by DuBose, the Board moved to approve the Maintenance and Grooming Applications for the Wild River Snowmobile Club, the North Branch Sno-Drifters, and the Rush City Sno-Bugs.  The motion carried as follows:  IN FAVOR THEREOF:  DuBose, Greene, McMahon, Montzka, Robinson OPPOSED: None.

RESOLUTION NO. 19/0501-6
AUTHORIZING SPONSORSHIP OF SNOWMOBILE TRAILS
OPERATED BY THE WILD RIVER SNOWMOBILE CLUB

BE IT RESOLVED, that the Chisago County Board of Commissioners act as the legal sponsor for an application for funding to the State of Minnesota Department of Natural Resources for maintenance and grooming of snowmobile trails managed by the Wild River Snowmobile Club.

BE IT FURTHER RESOLVED, that upon approval of its application by the state, the Chisago County Board of Commissioners may enter into an agreement with the State of Minnesota for the above referenced project and that it will comply with all applicable laws and regulations as stated in the agreement.

BE IT FURTHER RESOLVED, that the County Auditor is hereby authorized to serve as the fiscal agent for the above referenced project.

RESOLUTION NO. 19/0501-7
AUTHORIZING SPONSORSHIP OF SNOWMOBILE TRAILS
OPERATED BY THE NORTH BRANCH SNO-DRIFTERS

BE IT RESOLVED, that the Chisago County Board of Commissioners act as the legal sponsor for an application for funding to the State of Minnesota Department of Natural Resources for maintenance and grooming of snowmobile trails managed by the North Branch Sno-Drifters.

BE IT FURTHER RESOLVED, that upon approval of its application by the state, the Chisago County Board of Commissioners may enter into an agreement with the State of Minnesota for the above referenced project and that it will comply with all applicable laws and regulations as stated in the agreement.

BE IT FURTHER RESOLVED, that the County Auditor is hereby authorized to serve as the fiscal agent for the above referenced project.

RESOLUTION NO. 19/0501-8
AUTHORIZING SPONSORSHIP OF SNOWMOBILE TRAILS
OPERATED BY THE RUSH CITY SNO-BUGS

BE IT RESOLVED, that the Chisago County Board of Commissioners act as the legal sponsor for an application for funding to the State of Minnesota Department of Natural Resources for maintenance and grooming of snowmobile trails managed by the Rush City Sno-Bugs.

BE IT FURTHER RESOLVED, that upon approval of its application by the state, the Chisago County Board of Commissioners may enter into an agreement with the State of Minnesota for the above referenced project and that it will comply with all applicable laws and regulations as stated in the agreement.

BE IT FURTHER RESOLVED, that the County Auditor is hereby authorized to serve as the fiscal agent for the above referenced project.

On motion by McMahon, seconded by Montzka, the Board moved to approve the updated ARMER Radio Interim USER Agreement, authorize the County Board Chair, Attorney and Administrator to execute such with interested partners, and direct County staff to continue efforts to complete the transition of old County ARMER Radios to the same interested partners, as presented at tonight’s Meeting.  The motion carried as follows:  IN FAVOR THEREOF:  DuBose, Greene, McMahon, Montzka, Robinson OPPOSED: None.

On motion by McMahon, seconded by DuBose, the Board moved to approve the requested credit card at tonight’s meeting for Ami Helmbrecht of Health and Human Services.  The motion carried as follows:  IN FAVOR THEREOF:  DuBose, Greene, McMahon, Montzka, Robinson OPPOSED: None.

On motion by McMahon, seconded by DuBose, the Board moved to approve Out of State Travel Request for Chisago County Social Worker/Case Manager, Jocelyn Bruns to visit client in Out of State Care Facility.  The motion carried as follows:  IN FAVOR THEREOF:  DuBose, Greene, McMahon, Montzka, Robinson OPPOSED: None.

On motion by McMahon, seconded by Montzka, the Board moved to approve by Resolution the acceptance of a donation of desks and office furniture from the Department of Corrections Center City Office for Chisago County Probation Office.  The motion carried as follows:  IN FAVOR THEREOF:  DuBose, Greene, McMahon, Montzka, Robinson OPPOSED: None.

RESOLUTION NO. 19/0501-9
ACCEPTANCE OF DONATION BY CHISAGO COUNTY
ON THE CHISAGO COUNTY PROBATION OFFICE

WHEREAS, the Chisago County Board of Commissioners adopted Resolution No. 060419-3 on April 19, 2006 which established a policy regarding the acceptance of gifts by Chisago County; and

WHEREAS, the Chisago County Probation Office has received a donation from Minnesota Department of Corrections Center City Office and are requesting formal acceptance by the County Board of Commissioners;

NOW, THEREFORE, BE IT RESOLVED, that the Chisago County Board of Commissioners hereby accepts;

Assistant County Administrator Burnham provided the following updates: ARMER Radio Agreement Update, County Employee Thank you to the Commissioners.  No action was taken.

At 7:00 p.m., the Chair opened Citizen Forum.  0 Citizens spoke; the Chair closed Citizen Forum at 7:00 p.m.

Several Commissioners offered reports of their respective committee assignments. No action was taken.

On motion by McMahon, seconded by DuBose, the Board adjourned the meeting at 7:09 p.m.  The motion carried as follows:  IN FAVOR THEREOF:  DuBose, Greene, McMahon, Montzka, Robinson OPPOSED: None.
