CHISAGO COUNTY BOARD OF COMMISSIONERS OFFICIAL PROCEEDINGS Wednesday, March 04, 2020

(March 26, 2020)

The Chisago County Board of Commissioners met in regular session at 6:30 p.m. on Wednesday, March 04, 2020 at the Chisago County Government Center with the following Commissioners present: DuBose, Greene, McMahon, Montzka, Robinson.

Also present: County Attorney Janet Reiter, County Administrator Chase Burnham and Interim Clerk of Board Christina Vollrath.

The Chair called the meeting to order and led the assembly in the Pledge of Allegiance. Commissioner McMahon offered a motion to approve the amended agenda. Motion seconded by Greene, the motion carried as follows: IN FAVOR THEREOF: DuBose, Greene, McMahon, Montzka, Robinson OPPOSED: None.

On motion by Greene, seconded by Robinson, the Board moved to recess the Board of Commissioners meeting to the Health and Human Services Committee of the Whole. The motion carried as follows: IN FAVOR THEREOF: DuBose, Greene, McMahon, Montzka, Robinson OPPOSED: None.

The Chair opened the Health and Human Services Committee of the Whole at 6:31 p.m. Chair Montzka gave the gavel to Vice-Chair DuBose. Health and Human Services Director Robert Benson provided the following updates: MN Department of Human Services (DHS); Willow Grove; Collections within HHS; Coronavirus/Public Health; Tablets for Case Managers in Mental Health and Children’s Services; Aging and Disabilities Division Manager Interviews; Job Openings. No action was taken.

On motion by McMahon, seconded by Greene, the Board moved to add items 1-4 to the Consent Agenda. The motion carried as follows: IN FAVOR THEREOF: DuBose, Greene, McMahon, Montzka, Robinson. OPPOSED: None.

On motion by Montzka, seconded by McMahon, the Board moved to close the Health & Human Services Committee of the Whole. The motion carried as follows: IN FAVOR THEREOF: DuBose, Greene, McMahon, Montzka, Robinson OPPOSED: None. The Chair closed the Community Health Board and HHS Committee Board of the Whole at 6:46 p.m.

On motion by Greene, seconded by DuBose, the Board moved to approve the Consent Agenda. The motion carried as follows: IN FAVOR THEREOF: DuBose, Greene, McMahon, Montzka, Robinson OPPOSED: None.

Application for Exempt Gambling Permit – Almelund Threshing Company

RESOLUTION NO: 20/0304-1 APPROVING THE SUBMISSION OF AN APPLICATION TO CONDUCT A RAFFLE FOR ALMELUND THRESHING COMPANY

WHEREAS, the Chisago County Board of Commissioners has been presented with a request for lawful gambling within Chisago County; and

WHEREAS, the application was complete, included all necessary documentation, appears in accordance with County Policies and the facility owners are in good standing with the County;

BE IT RESOLVED that the Chisago County Board of Commissioners hereby approves and authorizes submission to the Minnesota Gambling Control Board an application to conduct a raffle at the Almelund Threshing Company located at 17760 St. Croix Trail, Shafer, MN 55084.

Application for Exempt Gambling Permit – Acres for Life – Therapy and Wellness Center

RESOLUTION NO: 20/0304-2 APPROVING THE SUBMISSION OF AN APPLICATION TO CONDUCT A RAFFLE FOR ACRES FOR LIFE – THERAPY AND WELLNESS CENTER

WHEREAS, the Chisago County Board of Commissioners has been presented with a request for lawful gambling within Chisago County; and

WHEREAS, the application was complete, included all necessary documentation, appears in accordance with County Policies and the facility owners are in good standing with the County;

BE IT RESOLVED that the Chisago County Board of Commissioners hereby approves and authorizes submission to the Minnesota Gambling Control Board an application to conduct a raffle at Abella Weddings and Events located at 11720 256th St., Chisago City, MN 55013.

On motion by McMahon, seconded by Greene, the Board moved to approve the Cooperative Construction Agreement with MnDOT for TH 8/CSAH 26 Roundabout Project.

RESOLUTION NO: 20/0304-3 TH 8 AND CSAH 26 RAB COOP CONSTRUCTION AGREEMENT 1035297

IT IS RESOLVED, that the Chisago County enter in MnDOT Agreement No. 1035297 with the State of Minnesota, Department of Transportation for the following purposes: To provide for payment by the County to the State of the County’s cost for construction engineering for non-trunk highway eligible construction to be performed upon, along, and adjacent to Trunk Highway No. 8 from 1,324 feet west of County State Aid Highway (C.S.A.H.) No. 26 to 965 feet east of County State Aid Highway No. 26 and on County State Aid Highway No. 26 from 594 feet south of Trunk Highway No. 8 to 1,166 feet north of Trunk Highway No. 8 under State Project No. 013-626-007 and No. 1301-127 (8=046).

IT IS FURTHER RESOLVED that the County Board Chair and the County Administrator are authorized to execute the Agreement and any amendments to the Agreement. The motion carried as follows: IN FAVOR THEREOF: DuBose, Greene, McMahon, Montzka, Robinson OPPOSED: None.

On motion by Robinson, seconded by McMahon, the Board moved to approve the SAP 13-639-004 CSAH 39 Bridge Replacement. The motion carried as follows: IN FAVOR THEREOF: DuBose, Greene, McMahon, Robinson, Montzka OPPOSED: None.

On motion by McMahon, seconded by Greene, the Board moved to adopt a resolution to authorize a Special Assessment and the related Assessment Agreement for Rosehill Properties, LLC.

RESOLUTION NO: 20/0304-4 A RESOLUTION TO AUTHORIZE A SPECIAL ASSESSMENT WHEREAS, the Chisago County Board of Commissioners approved an Agreement with the Saint Paul Port Authority (the “SPPA”) on April 20, 2016 designating the SPPA to implement and administer the Property Assessed Clean Energy (“PACE of MN”) improvement financing on behalf of the County and providing for the imposition of special assessments pursuant to Minnesota Statutes Section 216C.435 and 216C.436 and Chapter 429 (the “Act”); and as needed in connection with that program; and

WHEREAS, Chisago County wishes to encourage commercial, industrial, and housing investment, and to be proactive in preparing for applications and petitions for Special Assessments from owners of property located in Chisago County desiring to participate in and receive financing pursuant to the Act; and

WHEREAS, the property owner(s) have submitted PACE of MN applications to SPPA and are requesting that the County impose a special assessment on their property tax bill; and

WHEREAS, SPPA has reviewed the applications and determined that the interested property owners meet all eligibility requirements under PACE OF MN; and WHEREAS, SPPA, on behalf of the property owner, requests that the County apply a special assessment and collect repayment on property tax bills on behalf of the SPPA; and

WHEREAS, after imposition of the special assessments, the County shall collect such assessments and remit them to the Port Authority for use in the repayment of the Loan(s) or Bond(s) and the County will take all action permitted by law to recover the assessments, including without limitation, reinstating the outstanding balance of assessments when the land returns to private ownership, in accordance with Minnesota Statute Section 429.071, Subd. 4; and

WHEREAS, the special assessment shall be certified to the County Auditor and entered onto the tax lists for the year and the annual installment and interest shall be collected at the same time and in the same manner as real property taxes.

NOW, THEREFORE BE IT RESOLVED, the Chisago County Board of Commissioners requests the County Auditor to extend the proposed special assessment plus interest on the following properties: Owner: Rosehill Properties, LLC Property Location: Lindstrom, MN PIN: 15.00621.90 Assessment Request: $1,000,000 Interest Rate: Info to be provided 7.1% Interest Starts Accruing: to be provided Term: to be provided: 20 Years Such assessments shall be payable in equal annual principal and interest installments extending over the term of the special assessment, the first of the installments to be payable with general property taxes in 2021, and shall bear interest at the rates per annum and interest start dates stated above, and to the first installment shall be added interest on the entire assessment from the interest start date until December 31 of the tax payable year to which the first installment will be extended, and to each subsequent installment, when due, shall be added interest for one year on all unpaid installments and to each installment shall also be added the special assessment administration fee required by Minnesota Statute 429.061, Subd. 5; and

FURTHER BE IT RESOLVED, the Chisago County Board of Commissioners directs the Clerk to send a certified copy of this resolution to the County Auditor to extend these assessments on the property tax lists of the County. The motion carried as follows: IN FAVOR THEREOF: DuBose, Greene, McMahon, Montzka, Robinson OPPOSED: None.

On motion by DuBose, seconded by McMahon, the Board moved to approve the 2020 Aquatic Invasive Species Prevention Aid Program including the specific agreements, personnel actions, and Memorandum of Understanding as presented at tonight’s meeting. The motion carried as follows: IN FAVOR THEREOF: DuBose, Greene, McMahon, Montzka, Robinson OPPOSED: None.

On motion by Robinson, seconded by Greene, the Board moved to formally recognize Mr. Harley Johnson and all of Chisago County’s veterans for their service to Chisago County and the United States of America. The motion carried as follows: IN FAVOR THEREOF: DuBose, Greene, McMahon, Montzka, Robinson OPPOSED: None.

At 6:55 p.m., the Chair opened Citizen Forum. 23 Citizens spoke; the Chair closed Citizen Forum at 7:51 p.m. On motion by Robinson, seconded by McMahon, the Board moved to approve the resolution expressing opposition to any law that would restrict the constitutional rights of law-abiding Chisago County citizens to keep and bear arms.

RESOLUTION NO: 20/0304-5 SECOND AMENDMENT DEDICATED COUNTY RESOLUTION

WHEREAS, the Second Amendment of the United States Constitution reads “A well-regulated Militia, being necessary to the security of a free state, the right of the people to keep and bear Arms, shall not be infringed;” and

WHEREAS, the Chisago County Board of Commissioners wishes to express opposition to any law that would restrict the constitutional right of law-abiding citizens of Chisago County to keep and bear arms;

THEREFORE, BE IT RESOLVED by the Board of Commissioners of Chisago County, that the Chisago County Board of Commissioners hereby expresses its intent to uphold and protect the Second Amendment rights of the law-abiding citizens of Chisago County, and;

THEREFORE, BE IT RESOLVED that the Chisago County Board of Commissioners declare Chisago County as a "Second Amendment Dedicated County”, and;

THEREFORE, BE IT RESOLVED that the Chisago County Board of Commissioners hereby declare its intent to oppose any infringement on the right of law-abiding citizens to keep and bear arms, and;

THEREFORE, BE IT RESOLVED that the Chisago County Board of Commissioners support the ‘Safe School Levy’ legislation increase. The motion carried as follows: IN FAVOR THEREOF: DuBose, Greene, McMahon, Montzka, Robinson OPPOSED: None.

Several Commissioners offered reports of their respective committee assignments. No action was taken. On motion by Greene, seconded by McMahon, the Board adjourned the meeting at 8:18 p.m. The motion carried as follows: IN FAVOR THEREOF: DuBose, Greene, McMahon, Montzka, Robinson OPPOSED: None.
