MEETING OF THE
BOARD OF SUPERVISORS OF
NESSEL TOWNSHIP, MINNESOTA -
HELD: May 12, 2020

Pursuant to due call and notice thereof, a regular meeting of the Board of Supervisors of Nessel Township, Chisago County, Minnesota, was duly held telephonically on Tuesday, the 12th day of May, 2020, at 7:00 p.m., for the purpose in part of calling for public hearings on the establishment of written business subsidy criteria, a proposed business subsidy, and property tax abatement.
The following members were present: Betsy Rising, Michelle Meis, John Paitl and Branden Mell;
and the following were absent Jared Landon.
Member Branden Melc introduced the following resolution and moved its adoption:
RESOLUTION NO. 06-2020
RESOLUTION CALLING FOR A PUBLIC HEARING ON THE ADOPTION OF WRITTEN BUSINESS SUBSIDY CRITERIA, A PROPOSED BUSINESS SUBSIDY TO QWEST, AND A PROPOSED PROPERTY TAX ABATEMENT
WHEREAS, Minnesota Statutes, Sections 116J.993 to 116J.995 (the "Business Subsidy Act"), authorizes a grantor of business subsidies, upon satisfaction of certain conditions, to adopt a set of written criteria for awarding business subsidies; and
WHEREAS, the Nessel Township (the "Town") proposes to adopt written criteria for the granting of business subsidies and to consider a business subsidy to Qwest Corporation, d/b/a Century Link QC to pay a portion of the costs of the construction and installation of high speed internet within the Town (the "Project"); and
WHEREAS, subject to the requirements of Minnesota Statutes, Sections 469.1812 through 469.1815 (the "Abatement Act"), the Town may grant an abatement of all or a portion of the taxes imposed by the Town on one or more parcels of property to pay for all or part of the cost of the Project, whether or not located on or adjacent to the parcels for which the tax is abated, and may issue its general obligation tax abatement bonds; and
WHEREAS, the Town proposes to finance a portion of the costs of the Project through the issuance of general obligation tax abatement bonds; and
WHEREAS, the Township must hold public hearings prior to the adoption of business subsidy criteria or the granting of a business subsidy pursuant to the Business Subsidy Act, and prior to the adoption of a resolution granting property tax abatements pursuant to the Abatement Act.
NOW THEREFORE, BE IT RESOLVED by the Board of Supervisors of Nessel Township, Minnesota, as follows:
(1) Public Hearing.The Board of Supervisors shall meet on Tuesday, June 9, 2020, at approximately 7:00 p.m., to hold public hearings on (i) the adoption of written criteria for awarding business subsidies in accordance with the Business Subsidy Act; (ii) a proposed business subsidy to Qwest; and (iii) a property tax abatement to finance a portion of the Project in accordance with the Abatement Act.
(2) Notice. The Town Clerk is authorized and directed to cause notice of the hearings, in substantially the form attached hereto as Exhibit A (with the property identification numbers filled in according to the analysis provided by the City's municipal advisor, Ehlers & Associates), to be published at least once in the official newspaper of the Town at least 11 days but not more than 30 days before the hearings.
The motion for the adoption of the foregoing resolution was duly seconded by member Betsy Rising and, upon a vote being taken thereon after full discussion thereof, the following voted in favor thereof:
Michelle Meis, John Paitl, Brandon Mell, Betsy Rising and the following voted against the same: --
Whereupon said resolution was declared duly passed and adopted.
