AN ORDINANCE AMENDING CHAPTER 115 OF THE CITY CODE
PEDDLERS, SOLICITORS, AND TRANSIENT MERCHANTS
The City Council of the City of Stacy hereby ordains:
SECTION 1. Section 115.02 of the City Code is hereby amended to revise the following definitions:
PEDDLER. A person who goes from house-to-house, door-to-door, business-to-business, street-to-street (ice cream truck), or any other type of place-to-place movement, for the purpose of offering for sale, displaying for exposing for sale, selling or attempting to sell, and delivering immediately upon sale, the goods, wares, products, merchandise, or other personnel property that the person is carrying or otherwise transporting. For purpose of this chapter, the term PEDDLER shall have the same common meaning as the term HAWKER. The term PEDDLER shall not apply to any persons who may sell or peddle the products of farm or garden occupied and cultivated by themselves or who sells at a stand at the Farmers Market.
TRANSIENT MERCHANT. A person who temporarily sets up business out of a vehicle (food truck), trailer, boxcar, tent, other portable shelter, or empty store front for the purpose of exposing or displaying for sale, selling or attempting to sell, and delivering goods, wares, products, merchandise, or other personal property and who does not remain in any one location for more than 14 consecutive days.
SECTION 2. Section 115.04 (H) of the City Code is hereby amended to add item (H)(3) to read as follows:
Revision:
(3) Any person participating in an organized event; the event organizer is required to provide data to the city regarding the vendor including name, type of business, and contact information; events held on public property which are not an official organized event require a permit from the city;
SECTION 2. Effective Date. This ordinance shall take effect from and after its passage and publication.
