Parental rights termination upheld by MN Appeals Court

Chisago County’s child protection system was correct in terminating parental rights of a mother to a baby born while she was in residential treatment for substance abuse. Judge John McBride allowed a Chisago County petition to terminate parental rights in December 2012 and last week the MN Appeals Court affirmed that decision. The appeal was filed by a woman who had five of her biological children taken away from her, and who argued to keep the sixth. Lindstrom attorney Jesse Johnson said she was making headway and should be allowed to keep the newborn.

Parties were all identified in the Appeals Court decision by initials only. In 2006 the appellant had two children taken when parental rights were terminated in Ramsey County. In 2007 another child was adopted out with her consent. In 2012 her parental rights were terminated involuntarily, again in Ramsey County, and two children were removed. The Appeals Court said the woman did not prove that her recent sober lifestyle choices were permanent or that she would provide stable housing. The Appeals Court said due to her series of relapses in the past, and her not remaining in contact with people who provide her children with services, and other factors, the local court was right to terminate parental rights.
