The Chisago County Board of Commissioners met in regular session at 6:30 p.m. on Wednesday, April 03, 2024 at the Chisago County Government Center with the following Commissioners present: Rick Greene, Marlys Dunne, Ben Montzka, Dan Dahlberg. Also present: County Administrator Chase Burnham, Clerk of the Board Christina Vollrath, and County Attorney Janet Reiter.

Chisago County Commissioner Jim Swenson will be attending the Chisago County Board of Commissioners meetings on Wednesday, April 3 at 6:30 p.m. and all other Committees until April 5th via Interactive TV, pursuant to Minnesota Statute 13D.02 and MN Department of Administration Advisory Opinions 08-034 and 13-009. Commissioner Swenson may be seen and heard at the meeting via electronic means and will participate from La Cabana Resort. J.E. Irausquin Blvd., Orangestad, Aruba, a location open and accessible to the public. Any questions can be directed towards Chase Burnham, County Administrator, at (651) 213-8877.

Chair Dunne called the meeting to order and led the assembly in the Pledge of Allegiance.

Commissioner Greene offered a motion to approve the agenda. Motion seconded by Montzka, the motion carried as follows: IN FAVOR THEREOF: Greene, Dunne, Montzka, Dahlberg. OPPOSED: None. PRESENT: Swenson

On motion by Dahlberg, seconded by Montzka, the board moved to open the Health and Human Services Committee of the Whole at 6:32 p.m. The motion carried as follows: IN FAVOR THEREOF: Greene, Dunne, Montzka, Dahlberg OPPOSED: None. PRESENT: Swenson.

Chair Dunne gave the gavel to Vice-Chair Dahlberg.

Health and Human Services Director Robert Benson provided the Director’s Report and department updates. No action was taken.

On motion by Montzka, seconded by Greene, the Board moved to add items 1-5 to the Consent Agenda. The motion carried as follows: IN FAVOR THEREOF: Greene, Dunne, Montzka, Dahlberg OPPOSED: None. PRESENT: Swenson.

On motion by Montzka, seconded by Greene, the board moved to close the HHS Committee Board of the Whole at 6:44 p.m. The motion carried as follows: IN FAVOR THEREOF: Greene, Dunne, Montzka, Dahlberg OPPOSED: None. PRESENT: Swenson

On motion by Dahlberg, seconded by Montzka, the Board moved to approve the Consent Agenda. The motion carried as follows: IN FAVOR THEREOF: Greene, Dunne, Montzka, Dahlberg. OPPOSED: None. PRESENT: Swenson.

RESOLUTION NO: 24/0403-1
PROCLAIMING CHILD CARE PROVIDER APPRECIATION DAY IN CHISAGO COUNTY


WHEREAS, quality early childhood services, such as childcare, represent a valuable investment in our children’s future, as well as the future of our state; and

WHEREAS, each day numerous Chisago County children, families, and community members benefit from the dedication and quality care that is brought forth through the childcare profession by the 57 licensed family childcare providers of Chisago County; and

WHEREAS, the statewide lack of child care has created increased strain on child care providers and the families of Chisago County who depend on them; providers have continued to meet the needs of families while struggling to balance the needs of their family and the families they care for; and

WHEREAS, as these dedicated community members act out of compassion to instill positive values by good role modeling, where all families and children are met with understanding, acceptance, nurturing and guidance; and

WHEREAS, Child Care Providers frame a community by encouraging young minds and bodies to continue to grow and contribute to our community. This truly represents community participation; by virtue of devotion to fellow citizens, often with little recognition or remuneration for the vital work they do.

NOW, THEREFORE BE IT RESOLVED that the Chisago County Board of Commissioners hereby offers it’s heartfelt thanks to the Licensed Family Care Providers, and declares Friday, May 10, 2024, to be Child Care Provider Appreciation Day.

7) Payment of County’s Warrants and Miscellaneous Bills Total: $366,732.74

Per Minnesota Statutes 375.1, proceedings of the County Board including a list of itemized accounts, claims or demands must be published in the official newspaper. The itemized list of claims is available for public review on the County website at https://www.chisagocounty.us/1197/Claims-Paid. Claims less than $2,000 are listed as a total dollar amount and notes the number of claims included in the total.

On motion by Greene, seconded by Montzka, the Board moved to accept the 2024 Chisago County Assessment Report. The motion carried as follows: IN FAVOR THEREOF: Greene, Dunne, Montzka, Dahlberg OPPOSED: None. PRESENT: Swenson.

On motion by Montzka, seconded by Dahlberg, the Board moved to approve Multi-Agency Law Enforcement Joint Powers Agreement (JPA) for Minnesota Internet Crimes Against Children (ICAC) on behalf of the Chisago County Attorney’s Office.

RESOLUTION NO: 24/0403-02
RESOLUTION APPROVING STATE OF MINNESOTA JOINT POWERS AGREEMENTS WITH THE COUNTY OF CHISAGO ON BEHALF OF ITS SHERIFF REGARDING THE MINNESOTA INTERNET CRIMES AGAINST CHILDREN TASK FORCE (ICAC)


WHEREAS, the County of Chisago on behalf of its County Attorney desires to enter into Joint Powers Agreements with the State of Minnesota, Department of Public Safety, Bureau of Criminal Apprehension to utilize applicable state and federal laws to investigate and prosecute crimes committed against children and the criminal exploitation on children that is committed and/or facilitated by or through the use of computers.

NOW, THEREFORE, BE IT RESOLVED by the County Board of Chisago County, Minnesota as follows:

1. That the State of Minnesota Joint Powers Agreements by and between the State of Minnesota acting through its Department of Public Safety, Bureau of Criminal Apprehension and the County of Chisago on behalf of its County Attorney are hereby approved. Copies of the Joint Powers Agreements are attached to this Resolution and made a part of it.

2. That the County Attorney – Janet Reiter or her successor, is designated the Authorized Representative. The Authorized Representative is also authorized to sign any subsequent amendment or agreement that may be required by the State of Minnesota to maintain the County’s connection to the systems and tools offered by the State.

3. That Marlys Dunne, the Chair of the County of Chisago, and Christina Vollrath, the County Board Clerk, are authorized to sign the State of Minnesota Joint Powers Agreements.

On motion by Montzka, seconded by Greene, the Board moved to approve the resolution to develop a grant program to help Chisago County update and maintain section corners and pursue a grant for this program.

RESOLUTION NO: 24/0403-3
GRANT PROGRAM FOR THE PERPETUATION OF THE PUBLIC LAND SURVEY SYSTEM (PLSS) MONUMENTS

WHEREAS, In 2023, the Minnesota Legislature, through MN Statute 381.125, directed the Minnesota Geospatial Information Office (MnGeo) to develop a grant program for the perpetuation of the Public Land Survey System (PLSS) monuments; and

WHEREAS, Chisago County is responsible for maintaining the PLSS; and

WHEREAS, Chisago County has identified 237 section corners county-wide; and

WHEREAS, the total cost and request will be $125,000.

THEREFORE, BE IT RESOLVED, that the Chisago County Board of Commissioners authorizes the appropriate county officials to submit a proposal to MnGeo for the Minnesota PLSS Monument Grant Program and, if awarded, authorize the appropriate county officials to accept the grant and enter into the necessary agreements beginning in February 2024 and running through March 31, 2026.

On motion by Greene, seconded by Dahlberg, the Board moved to award the 2024 Seal Coat Project Contract to Pearson Brothers of Hanover, Minnesota, and to authorize and to enter into the 2024 Seat Coat Project Contract with said contractor in an amount not to exceed $797,471.38. The motion carried as follows: IN FAVOR THEREOF: Greene, Dunne, Montzka, Dahlberg OPPOSED: None. PRESENT: Swenson.
