ORDINANCE NO. 324

CHAPTER 178 ESTABLISHING MORATORIUM ON MASSAGE ESTABLISHMENTS AND MASSAGE THERAPISTS LICENSES

On November 12, 2024 the City Council of the City of Chisago adopted Ordinance No. 325 Chapter 178, an ordinance establishing a moratorium on massage establishments and massage therapists licenses. The interim ordinance declares a moratorium on the operation of such businesses and authorizes a study to determine if and how the City wishes to regulate them. The moratorium has a duration of six months, but can be extended another six months if voted on by the council. The full text of the ordinance is available for inspection at Chisago city hall during regular business hours and has been posted to the City’s website.

RESOLUTION NO. 24-11-05

RESOLUTION ADOPTING INTERIM ORDINANCE NO. 325 CHAPTER 178 ESTABLISHING A MORATORIUM ON MASSAGE ESTABLISHMENTS AND MASSAGE THERAPISTS LICENSES IN CHISAGO CITY, MINNESOTA, AND DIRECTING THE PUBLICATION OF AN OFFICIAL SUMMARY THEREOF.

WHEREAS, on October 22, 2024 the City Council directed the City staff to draft an interim ordinance that would establish a moratorium on the sale of massage establishments and massage therapists licenses; and

WHEREAS, on November 12, 2024 the City Council directed the City staff, consultants and its Planning Commission to study: (a) the issues and potential impacts of massage establishments within the City on the health and welfare of the City and its residents, (b) massage license requirements and related regulations, and (c) Zoning regulations related to the operation and regulation of massage establishments within the City; and

WHEREAS, Minnesota Statutes 462.355, Subd. 4 grants the City Council the authority to impose a moratorium on massage establishments and on massage therapists licenses in the City until the foregoing study has been completed and any recommended changes implemented by the City; and

WHEREAS, the City Council has reviewed and hereby desires to approve Interim Ordinance No. 325 in the form attached hereto.

RESOLUTION

NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF CHISAGO CITY, MINNESOTA:

1. RESOLVED, Interim Ordinance No. 325 Chapter 178 in the form attached hereto as Exhibit A is hereby approved and the City’s Mayor and City Administrator are authorized and direct to execute the Interim Ordinance by and on behalf of the City.

2. FURTHER RESOLVED, the Official Summary of Interim Ordinance No. 325 Chapter 178 in the form attached hereto as Exhibit B is hereby approved and City staff are authorized to publish such Official Summary in the City’s official newspaper as required by the City Code.

3. FINALLY RESOLVED, by the City Council of the City of Chisago that the city administrator keep a copy of the ordinance in his office at city hall for public inspection and that he post a full copy of the ordnance on the City’s website and in a public place in city hall.
