AN ORDINANCE AMENDING CHAPTER 111 OF THE LINDSTROM CITY CODE CONCERNING RESTAURANT LIQUOR LICENSING


THE CITY COUNCIL OF LINDSTROM ORDAINS:


SECTION 1. Lindstrom City Code Chapter 111, Section 111.003 is hereby amended by adding the underlined language and deleting the strikethrough language as follows:
For the purpose of this subchapter, the following definitions shall apply unless the context clearly indicates or requires a different meaning. These terms are in addition to the definitions included in M.S. Chapter 340A, as it may be amended from time to time.

FULL SERVICE RESTAURANT. A restaurant in which the majority of food constitutes meals, served in consideration of payment therefor, prepared within a kitchen upon the licensed premises on a daily basis. The “full service” requirement is not satisfied by the service of snacks, sandwiches, pizzas or any food prepared and/or assembled off the premises, leaving the primary remaining function of the licensee the process of heating and/or serving of the food.

RESTAURANT. An establishment, other than a hotel, under the control of a single proprietor or manager, where meals are regularly prepared on the premises and served at tables to the general public, and having appropriate facilities and a minimum seating and meal serving capacity for at least 30 guests at one time, and where, in consideration of payment therefor, meals are regularly served at tables to the general public, and that employs an adequate staff to provide the usual and suitable service to its guests.
SECTION 2. Lindstrom City Code Chapter 111, Section 111.043(A) is hereby amended by deleting the strikethrough language as follows:


“On-sale” liquor and “on-sale wine” licenses may be issued only to full-service restaurants, as defined in this chapter.


SECTION 3. Lindstrom City Code Chapter 111, Section 111.047 is hereby amended by deleting the strikethrough language as follows:


The on-sale liquor license of any current licensee who reduces the level of service as to be out of compliance with the “full service restaurant” provisions of this subchapter is subject to suspension and revocation, as outlined herein.


SECTION 4. This ordinance shall be effective immediately upon its passage and publication.


ADOPTED this 15th day of January, 2025, by the City Council of the City of Lindstrom, Minnesota.
