RESOLUTION 25-02-03
ADOPTING AN INTERIM ORDINANCE (MORATORIUM) TO REVIEW THE HOTEL LICENSING ORDINANCE #17-05-22 AND THE ZONING AND SUBDIVISION ORDINANCE #2024-12-00 PERTAINING TO HOTELS, MOTELS, MULTIPLE-FAMILY DWELLINGS, APARTMENTS, AND CONDOMINIUMS WITHIN THE DOWNTOWN COMMERCIAL ZONING DISTRICT, AS WELL PERFORMANCE STANDARDS, INCLUDING BUILDING MATERIALS IN THE CITY OF TAYLORS FALLS, COUNTY OF CHISAGO, STATE OF MINNESOTA
WHEREAS, pursuant to Minnesota Statutes section 462.357, the City has the authority to regulate the use of land through the adoption and enforcement of official controls; and
WHEREAS, pursuant to Minnesota Statutes section 462.355, the City has the authority to adopt an interim zoning ordinance for the purpose of protecting the planning process and health, safety, and welfare of its citizens; and
WHERAS, the City desires to protect the planning process by providing sufficient time for its review of the City’s Zoning and Hotel Ordinance prior to any further permitting of hotels, motels, multiple-family dwellings, apartments, and condominiums within the Downtown Commercial Zoning District.
WHERAS, the City desires to protect the planning process by ensuring that any ordinance changes need not be expedited and that all issues related to the uses of hotels, motels, multiple-family dwellings, apartments, and condominiums can be completely examined; and
WHERAS, the City desires to protect the public health, safety and welfare of its citizens by its study of its official controls in these areas; and
WHERAS, the Taylors Falls City Council deems it necessary to adopt an ordinance placing a moratorium on all permit applications submitted after March 6, 2025, for hotels, motels, multiple-family dwellings, apartments, and condominiums, for a period of 365 days from the effective date of this ordinance to permit the planning process to take place to study the issue, and to allow City staff, the Planning Commission, and the City Council sufficient time to proceed in an orderly fashion to make any necessary changes, modifications, and updates to the City’s official controls.
NOW, THEREFORE, the City of Taylors Falls Council Hereby Ordains:
Ordinance No. 2025-02-00
Section 1:
Purpose. This ordinance establishes a moratorium to provide sufficient time for City staff, Planning Commission, and City Council to research appropriate Hotel Ordinance and Zoning Ordinance criterion for hotels, motels, multiple-family dwellings, apartments, and condominiums within the Downtown Commercial Zoning District, as well as performance standards, including building materials.
Section 2:
Temporary Restrictions. For a period of 365 days from the effective date of this moratorium, or until such earlier time as the City Council determines by resolution that the reasons for the moratorium no longer exist, the City shall not accept, process, or approve any pending or future permit applications for hotels, motels, multiple-family dwellings, apartments, and condominiums within the Downtown Commercial Zoning District submitted after March 6, 2025.
Section 3:
Enforcement. The City of Taylors Falls may enforce any provision of this Ordinance by any and all means authorized by Taylors Falls Ordinances and State Statutes.
Section 4:
Effective Date. The Ordinance is effective upon publication of the Ordinance in the Chisago County Press, and shall be in effect for a period of 365 days, unless earlier terminated by the Taylors Falls City Council.
Section 5:
Severability. Every section, provision, or part of this Interim Ordinance is declared severable from every other section, provision, or part thereof to the extent that if any section, provision, or part of this Ordinance shall be held invalid by a court of competent jurisdiction, it shall not invalidate any other section, provision, or part thereof.
