Shafer City council met September 15 for a regular meeting.  Council member Nick Brehm was absent.

In new business, the council discussed a conditional use permit for 30041 Redfield Blvd.  The property has been owned and used by PLC owners Sean and Missy McMurray.  The McMurrays have since relocated the towing lot to a parcel in the industrial park and are looking to sell the property on Redfield.  City clerk Valerie Fox told the council in 2016, a CUP was approved by the planning commission, which also had a public hearing and was ultimately approved by the council.  There was no formal CUP document prepared by the city’s legal counsel for recording at the county level. It was only motioned that PLC was granted a CUP for outdoor storage with the installation of an eight foot privacy fence.  

The owners have a buyer but fear that a new official CUP will complicate the sale process.  

Mayor Paula Hanson said it was a clerical error on the city’s end and is not the fault of the property owners for the city’s lack of due diligence.

City Attorney James Monge stated that the process is somewhat more complex than simply obtaining council approval for a Conditional Use Permit (CUP). He indicated that he could research to see if he can draft an official CUP and request the former Mayor and previous clerk to sign it. Monge also mentioned that he will prepare a letter to be provided to PLC in the interim, demonstrating to potential buyers that a CUP is under construction. 

Council then made a motion to direct Fox to reach out to the previous Mayor and Clerk from 2016 to request them to sign a CUP that will be drafted and back dated by the current city’s attorney.

In the clerk’s report, Fox told council  Shafer Franconia Fire Department Chief Ed Kubicki informed Fox that he has initiated fire code inspections for businesses across the city and will provide updates to the council.
